1. Agreement to Terms

By engaging Majesty Web Design LLC ("Company," "we," "us," or "our") for any services, you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you are using our services on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.

We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.

2. Description of Services

Majesty Web Design provides web design, web development, SEO, and related digital services including:

  • Custom website design and development
  • Monthly website management and maintenance
  • Website hosting and security
  • Search engine optimization (SEO)
  • Google Business Profile setup and optimization
  • Content updates and modifications

The specific services included in your plan are detailed in your service agreement. All services are subject to our fair use policies.

3. Subscription & Billing

Payment Terms

Monthly plans are billed in advance on a recurring monthly basis. Your subscription begins on the date of your first payment and renews automatically each month unless cancelled.

Pricing

Current pricing is available at majestywebdesign.com/pricing. We reserve the right to change pricing with 30 days' written notice to existing clients.

Failed Payments

If a payment fails, we will attempt to collect payment for three (3) days. If payment is not received within 7 days of the due date, services may be suspended until the account is brought current.

4. Cancellation Policy

You may cancel your subscription at any time by providing written notice to majestywebdesign@gmail.com. Cancellation takes effect at the end of the current billing period — no refunds are issued for partial months.

Upon cancellation, your website will be taken offline. We will provide you with an export of all your content within 14 days of cancellation upon request.

5. Client Responsibilities

You agree to:

  • Provide accurate, complete, and timely information necessary for us to perform services
  • Maintain the confidentiality of any account credentials we provide
  • Ensure all content you provide does not violate any third-party rights
  • Respond to communications within 5 business days
  • Pay all fees when due

6. Intellectual Property

Your Content

You retain ownership of all content (text, images, logos) that you provide to us. By providing content, you grant us a license to use it solely for the purpose of providing services to you.

Website Design

Upon payment of all fees and termination of services, the website design created specifically for you transfers to your ownership. However, any design elements, code libraries, or templates used across multiple client projects remain the property of Majesty Web Design.

7. Acceptable Use Policy

You agree not to use our services to host, promote, or distribute content that:

  • Is illegal, harmful, threatening, abusive, or defamatory
  • Infringes on intellectual property rights of others
  • Contains malware, spam, or deceptive content
  • Violates any applicable law or regulation

8. Limitation of Liability

To the maximum extent permitted by law, Majesty Web Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities arising from the use or inability to use our services.

Our total liability for any claim shall not exceed the total amount paid by you in the three (3) months preceding the claim.

9. Dispute Resolution

Any disputes arising from these Terms or our services shall first be addressed through informal negotiation. If not resolved within 30 days, disputes shall be resolved by binding arbitration in the State of Michigan, except that either party may seek injunctive relief in a court of competent jurisdiction.
